IAHF LIST: I just faxed the enclosed letter to Bruce Artim on Senator Hatch's staff. Congressman Ron Paul's office is assisting me with this issue, and I just wanted to thank all of you who made it possible for me to get to Germany in order to monitor what went on. I'm working on a full report that I'll email to all of you very soon. Please use the letter below to educate your own members of Congress on the codex vitamin issue. Its just 2 pages, but anyone who takes the time to read it, and follow the links, will learn a lot. You'll find a link on it to Rath's site where you can see photos and video footage from the demonstration I was in in Berlin. It was a very effective protest, march, and counter meeting plus my spies inside the Codex meeting from 4 different countries delegations reported all pertinent details to me out in the street, and I hooked up with 3 new health freedom organizations in Europe!

There are some things discussed in this letter that aren't yet on the IAHF website, but will be as soon as I have a chance to scan them. Among them are the letter I sent to FDA questioning the legality of their actions at Codex and their response. Naturally they didn't bother to respond to that letter on a timely basis. They had a month to respond, but I didn't receive their response til June 16th, the day before I got on the plane to fly to the Codex meeting in Germany and Dr.Rath's demonstration. FDA has provided me with written proof that they are ignoring that amendment that we all worked so hard to get back in '97- the one that exempted dietary supplements from the harmonization language of the Food, Drug, and Cosmetic Act. Many of you were with me in that battle. If you recall, we made the Senate Labor Committee's fax machine run out of paper and ink with our complaints, and despite that effort to make our voices heard, they are being ignored as FDA ignores the law once again. What must happen before the FDA killers are stopped?

The amendment that we got back in '97 to the FDA Modernization Act makes it illegal for FDA to take any action at Codex that threatens to harmonize our dietary supplement laws to a more restrictive international standard. The only thing the FDA is legally mandated to do at Codex regarding the vitamin issue is to state that all work on the vitamin issue should immediately CEASE, and that the matter should best be left up to national authorities to decide. Instead of doing this, however, FDA has openly been ignoring the law as they work overtime to build consensus towards finalization of a Codex standard that promises to be highly unscientific, and dangerously restrictive. The Congressional Research Service has provided us with proof that many changes have been forced to US laws when we've lost trade disputes. FDA is clearly setting us up to lose in a trade dispute. They may also attempt to ignore the Administrative Procedures Act and try claiming that the NAS so called "risk assessment" paper gives them a "right" to move under DSHEA to start banning high potency vitamins. (DSHEA gives FDA enormous latitude to take anything off the market if they feel that it poses an "unreasonable or significant risk". Senator Hatch won't be in Congress forever to look out for us. He will be outlasted by many FDA bureaucrats who are working overtime to help the drug cartel attack us.

Although a legal precedent exists where OSHA was stopped from harmonizing their regs to an international standard because to do so violated the Administrative Procedures Act, since when has the FDA shown any concern about obeying the law? All we have to do to see that they ignore the law as a matter of course is to go to http://www.emord.com and examine how FDA is ignoring the Judges decision from Pearson v.Schalala. Pearson tried to sue them for contempt of court, but our courts are so corrupt that the Judge threw their case out and they're being forced to appeal. DSHEA gives FDA the right to Congress is going to have to provide an oversight hearing in order to look very closely at the whole situation discussed in the letter below.

I had numerous spies inside the meeting from 4 different countries delegations report back to me. (Report almost finished.)

I would have attended the meeting as a member of the US delegation, but I was kicked off the delegation due to my efforts as a whisleblower. I would have attended the meeting as a licensed, credentialled member of the Press, but there is no Freedom of Speech in Germany, and my request to attend was denied through an email message from Bgvv Press Officer Juergen Kundke. It seems that the Germans only recognize UPI, AP, and other mainstream media associations that duly pay homage to the Pharma-Cartel. A member in good standing of the American Media Association (AMA) need not apply. Kundke emailed me back stating that because the AMA is a private organization there is no proof. I emailed him back offering to fax him both sides of my press pass, a letter from the President of the AMA, and a letter from the Editor of Life Extension Magazine, but he did not reply. Codex lacks even the thinnest pretense of TRUE transparency.

After our street demonstration, Dr.Rath entered the German government building where the Codex meeting was underway, and was threatened with arrest by Chairman Grossklaus if he didn't leave the premises immediately. That sums up the basic situation regarding the Codex vitamin issue very succinctly. This scene was witnessed by GS Odin, an American vitamin manufacturer who also has a business in New Zealand. Odin was at the meeting on the New Zealand delegation representing the New Zealand Charter of Health Practitioners Inc. He set up shop in New Zealand due to having been raided in the USA by the FDA.

You will be contacted soon by Norman Singleton, L.A. and Joe Becker, L.D. from Congressman Paul's office who I am working closely with. FDA is violating the intent of Congress regarding paragraph (c)(5) of Section 803 of the Food, Drug and Cosmetic Act, and their letter to me indicates this clearly. This was that amendment that I worked so hard to get back in '97 to the FDA Modernization Act which specifically removed dietary supplements from the harmonization language. This forbids FDA from taking any action at Codex that threatens to set the USA up for harmonization to a more restrictive international standard regarding vitamins and minerals. All FDA can legally do at a Codex meeting vis a vis the vitamin issue is to state that the matters should best be left up to national authorities to decide. They have no legal mandate to assist in a consensus building process on the vitamin issue that is clearly intended to develop a very restrictive Codex vitamin standard that is grossly inconsistent with the will of the people as expressed through Proxmire, and DSHEA, yet that is exactly what they are doing.

On PAPER 19 U.S.C. 3512(a)(1) protects US law from harmonization to international standards, but the REALITY the American people face is another story as clearly reflected through a report by the Congressional Research Service 's Jeanne J. Grimmett titled "WTO Dispute Settlement" which clearly shows seven instances in which the USA lost trade disputes before the WTO, and Congress made changes to our laws under threat of trade sanctions against us. Not even state and local laws are safe when it comes to harmonization. Clearly, our sovereignty is being stripped from us at an alarming rate and none of our laws, not even DSHEA is safe. Soon you will see the letter FDA just sent me in response to my legal questions, and it does show that they're violating the law, but you won't get a clear picture from that letter alone: to really get a clear sense of the Codex vitamin issue, you need to examine the website of Matthias Rath, MD at http://www.rath.nl in and take special notice of the march, conference, and demonstration he just held in Berlin against the Codex meeting between June 17 - June 19th.

You also really should read Dr.Rick Malter's well written rebuttal to the National Academy of Science paper which the FDA illegally put on the table at Codex. Malters Rebuttal has been accepted for publication by the Journal of Orthomolecular Medicine, and will by published in the upcoming issue that comes out monday.

The FDA has been stopped by Congress, and our courts from blocking consumer access to dietary
supplements the way the pharma-cartel needs them to. It is obvious to me that they are looking for alternative means to defend the interests of the pharmaceutical industry, and they hope to utilize Codex towards that end.

In our phone conversation you asked me why I didn't feel protected by that amendment back in 1997 that I worked so hard to get. The answer is that I've been to Germany three times since '96, and I've seen first hand what is going on at Codex. The FDA is very highly skilled at the art of deception, they play Congress like a pinball machine, in the belief that this issue is so complex that people such as you who are in a position to stop them, simply won't have time to stay abreast of what is going on.

I have a genetic need for the vitamins I take. I have no choice but to pay VERY close attention to matters such as this. I am forced to do my own research, and really scrutinize the FDA's actions. I have, and it is very clear to me that the FDA is not only violating US law at Codex on the vitamin issue, but thus far, Congress has been letting them get away with it. I hope to come to Washington to discuss this with you. Multinational corporations don't run this country. The people do, and we are not happy about what we see unfolding regarding this situation. Codex makes a mockery of our whole system of representative government.
