This information is of profound importance if you value American sovereignty and your ongoing access to dietary supplements. Attached are the gif files that prove what I've been telling you for a long time now: that 5 members of Congress told FDA not to do what they went ahead and did ANYWAY at Codex in Berlin re Vitamins. The 5 who Dr.Yetley of FDA are ILLEGALLY ignoring are Burton, De Fazio, Paul, Stump, and Cook, but don't take my word for it- view the enclosed gif files and see for yourself. Then check this out:

1. Burton was told by the two biggest vitamin trade associations CRN and NNFA that a hearing on the Codex vitamin issue "isn't necessary." Check out http://www.crnusa.org/ See their membership section. You'll find that nearly half of their members are pharmaceutical companies, and they include several companies that helped fund the scientifically inaccurate, terribly biased NAS paper that FDA illegally put on the table at Codex over the direct objection of Burton, De Fazio, Paul, Stump and Cook.

2. You can view the NAS paper on my website at http://www.iahf.com/ under its own category on the scroll bar ("NAS PAPER") You can see commentary on it in the Codex oversight section of the IAHF website.

3. As discussed previously, this paper does not represent the will of the people as clearly expressed under:

A)The Proxmire Vitamin Act of 1976 (which forbids the FDA to ban consumer access to high potency vitamins) or under:

B) The Dietary Supplement Health and Education Act of 1994, and it directly contradicts the amendment that many of you assisted me in getting to:

C) The FDA Modernization act of 1997 wherein we got dietary supplements SPECIFICALLY EXEMPTED from the harmonization language of that bill which effects the whole REST of the Food, Drug, and Cosmetic Act.

In other words: The FDA has set us up via this terribly biased, unscientific, NAS paper for the total destruction of health freedom in America.

Don't take my word for it: See PROOF that this new International Court Called the Dispute Settlement Body of the World Trade Organization has been DISMANTLING the laws of nations as they interfere with multinational profits. See PROOF that they have been DISALLOWING testimony from individuals (no matter how well qualified) AND from Non Government Organizations.

In other words: When this has happened, lobbyists crawl all over Capital Hill (or through YOUR government offices if you live outside the USA) just like they did when they shoved NAFTA and GATT down the throats of the people of the world. They have forced changes in our Environmental Laws, to our Endangered Species Act, and most recently to our tax laws. Due to this there were 70,000 demonstrators in Seattle from all sides of the political spectrum who SHUT DOWN the WTO Ministerial Conference on November 30, 1999. I was one of those protestors, and you can see the TRUTH of this at http://www.indymedia.org/ which shows the TRUTH of what REALLY happened in Seattle- information which the Network TV News did NOT tell you and which they do NOT want you to know.

WHAT WE ARE DOING TO SAVE HEALTH FREEDOM IN THE USA AND WORLD WIDE

Recognizing that the NAS paper titled "A Risk Assessment Model for Establishing Upper Levels for Nutrients" is not scientific, that it contradicts the will of the American people and the will of Congress as specifically stated under American law as described above, I have enlisted the assistance of a team of MD's and Ph.D.s led by Rick Malter, Ph.D. to generate a carefully written, scientific rebuttal to the NAS paper which FDA is using illegally at Codex.

This rebuttal is almost finished, but it won't do us any good if we don't have enough people to do the following:

1. Call Congressman Burton c/o Beth Clay at 202-225-5074 and request that Burton follow through with his original promise long ago to hold an oversight hearing on the Codex vitamin issue so that we can bring our expert witnesses to the table and proove to Congress that FDA violated the law with the intent of making an end run around our current dietary supplement laws.

2. Call your own Senators and Congressmen via 202-225-3121 and tell them the same thing.

3. Show this to all of your friends and forward it widely.

4. Utilize the form letter below or borrow from it to write your own letter (best to write your own, but at least use this one (Also available in typeset, html format as attached file included in this mssg to print out):

Dear Congressman Burton:

We have viewed the gif files of two letters to the FDA signed by yourself, Congressman De Fazio, Congressman Paul, Stump, and Cook. You can view these letters at http://www.iahf.com/ under the Category "Letters from Congress" in case you don't remember having written it. (see Letter 1 and Letter 2)

Some of our people have been told by Beth Clay in your office that you intend to send a member of your staff to the upcoming Codex meetings of the Committee on Nutrition and Foods for Special Dietary Use in Berlin and Geneva this June, however this would not solve the problem.

The problem is that the FDA has broken the law. They have taken an action which was specifically forbidden via an act of Congress in 1997, but more importantly, they have taken an action which threatens to set the United States up for forced "harmonization" to the emerging highly restrictive Codex vitamin standard, which the FDA has not been properly trying to stop as desired by the American people.

The FDA is using a paper titled "A Risk Assessment Model for Establishing Upper Levels for Nutrients" at Codex over your objection. This paper has been expertly rebutted by several MDs and Ph.Ds working as a team led by Rick Malter, Ph.D. a practicing clinical psychologist with years of experience in the realm of orthomolecular medicine- a suppressed alternative treatment mode employing the use of vitamins and other natural substances protected under Proxmire and DSHEA.

The problem is how the Dispute Settlement Body of the WTO would view the unscientific NAS paper, which never underwent any public comments period prior to being used illegally by the FDA.
The DSB would view the NAS paper as the "Gold Standard" on Safety, and would use it to force the USA to harmonize its laws under threat of trade sanctions. Please let me know when you intend to hold an oversight hearing. I note that you are receiving PAC support from many pharmaceutical interests at http://www.fec.gov/. Please know that those multinational corporations do not represent the will of the American people. Please also know that they are well represented in the vitamin trade associations CRN and NNFA as clearly evidenced by the CRN website at http://www.crnusa.org/ and via the NNFA's membership directory, and that these vitamin trade associations are being controlled from the top down by pharmaceutical interests who clearly do not represent the will of the American people as expressed under our current vitamin laws.
